Civil penalty regime for non-consensual sharing of intimate images

The Australian Government is seeking your feedback on prohibiting the non-consensual sharing of intimate images, and implementing civil penalties to deter persons and content hosts who share intimate images or videos of another person without their consent.

Consultation process

The Australian Government has released a discussion paper for consultation on a proposed civil penalty regime for the non-consensual sharing of intimate images.

The term ‘non-consensual sharing of intimate images’ refers to the sharing or distribution of an image or video of a person or persons portrayed in a sexual or otherwise intimate manner, which has been shared without consent. This behaviour is colloquially referred to as ‘revenge porn’ or ‘image-based abuse’.

How to be involved

The Australian Government is seeking feedback on a proposal to prohibit the non-consensual sharing of intimate images or videos, and to implement a civil penalty regime to deter perpetrators and content hosts who share these images.

Written submissions on this issue will be received until 5pm on 30 June 2017, and may be made at https://www.communications.gov.au/have-your-say/civil-penalty-regime-non-consensual-sharing-intimate-images.

Face to face consultations will also occur through workshops, likely to be held in late July. The details of these workshops will be made available on the Department of Communications and the Arts website during the consultation process. If you would like to register your interest to attend a workshop, please email OnlineSafety@communications.gov.au and indicate how many people from your organisation would attend, and a preference for attending in Sydney, Melbourne or Canberra.
